After being arrested, man requests to be taken home or returned to Samoa
Pago Pago, AMERICAN SAMOA — On November 3, 2025, a man called the Tafuna Police Substation (TPS) and reported an alleged disturbance in Aloau.
A suspect was later apprehended and charged with Count 1: Public Peace Disturbance, a class B misdemeanor punishable by imprisonment for up to six months, a fine of $500, or both imprisonment and fine.
The defendant's bail was set at $500.
According to the court affidavit, filed in the District Court on Nov 4, 2025, on November 3, 2025, at around 7:54 p.m., an individual (the reporter) contacted the TPS from the village of Aloau.
The reporter alleged that a man was yelling and swearing in front of her house.
Police officers responded to the call and, upon arrival at the scene, the reporter flagged down the police unit and pointed out the suspect's location. A shirtless man was observed walking in front of the reporter's house.
The suspect, who was walking along the dirt road, barefoot and shirtless, was apprehended and placed in the police unit for transport to the police station.
Authorities immediately detected a strong odor of alcohol emitting from the suspect, and appeared heavily intoxicated due to slurred speech and repeatedly losing his balance while walking.
The suspect was later identified as Charles Spitzenberg.
Officers interviewed the reporter at the scene, and she stated that the suspect yelled and swore in front of her house. The reporter also noted that this is not the first time the suspect has done this.
She explained that on Saturday night, the suspect chased his wife and then yelled and swore in front of their house. The reporter told the authorities that the suspect had moved into his aunt's house, but does not know his name.
Police officers also interviewed two witnesses at the scene.
Witness #1 stated that he went to the store and he heard someone yelling and swearing in front of their house. Witness #2 corroborated witness #1's interview.
Following the interviews, the suspect was transported to the TPS and was Mirandized upon arrival.
The suspect requested to be taken home or returned to Samoa. During the booking process, the suspect appeared angry and challenged the authorities.
Immediately after the booking, the suspect was transported to the Tafuna Correctional Facility for confinement until the next available sitting of the District Court.
The defendant is identified as a 34-year-old citizen of Samoa.
