Alleged domestic abuse case goes to court

Pago Pago, AMERICAN SAMOA — A man was arrested two weeks ago on the allegation that he assaulted his wife.

A man has made his initial appearance in Court and is facing a single count of 2nd-degree assault involving domestic violence, a class D felony, punishable by a term of imprisonment of up to five years, a fine of up to $5,000, or both.

Bail is set at $15,000.

THE AFFIDAVIT

The government alleges that on the evening of Apr. 10, 2022, a man contacted the Fagatogo Central Police Station to report that a malewas acting disorderly by making loud noises and did in fact cause a disturbance at their residence.

Two police officer proceeded to check out the alleged claim as reported and officers met up with the reporter and another individual who briefed them.

They reported that when the suspect came home from work, he was already drunk. He then went straight to drink with his cousins at the umu.

A woman (later identified as his wife) went down to give cigarettes to her nephew but the suspect swore at her when she walked away to their home ignoring him. Iose came back to their residence and beat her using his hands and threw a mobile phone at her.

He then left with his work vehicle, backing up and hitting his father-in-law’s car which was parked on the side of the house, causing damage to the back of the vehicle. The victim told officers that the suspect had done this multiple times when he gets off from work.

Officers went to the residence and apprehended him from there and later transported him to the police station for questioning. During his arrest, officers smelled a strong odor of alcohol emitting from his breath. Officers tested for alcohol intoxication, which resulted in the percentage of 0.066%.
