Alleged rape with a gun involved brings a false imprisonment charge
Pago Pago, AMERICAN SAMOA — A man accused of raping a woman and pointing a gun at her face has entered into a plea agreement with the government.
Kamuta Fei, who has been in custody since his arrest last year, unable to post a $30,000 bond, appeared in High Court yesterday morning for his Change of Plea hearing.
Fei is charged in three separate cases.
In the first case, Fei is charged with rape and false imprisonment — both class C felonies, and a class A misdemeanor of third-degree assault. In the second case, Fei is charged with unlawful use of a weapon and false imprisonment, both felonies, along with two counts of third-degree assault. In the third case, Fei is charged with escape from confinement, a class D felony.
But under a plea agreement with the government that was accepted by the court, Fei pled guilty to the amended court one of first-degree sexual abuse in his first case, and unlawful use of a weapon in the second case.
By his plea, Fei admits that on Jan. 20, 2020, he pushed the victim into his truck while parked in Petesa where he touched the victim inappropriately without her consent. Fei further admits that while the victim was trying very hard to push him away, he continued to sexually abuse her by touching her inappropriately.
For the count of unlawful use of a weapon, Fei admits that on Feb. 13, 2020 he pointed a handgun at the face of the victim during an argument in his truck in front of his Malaeimi residence. Fei further admits that the reason he did this was to threaten the victim in an effort to have sexual intercourse with her.
As part of the plea agreement, the government recommended sentencing the defendant to a term of imprisonment and departure (Fei is a citizen of Samoa). The government asserts that the defendant is a danger to the victim and to the community.
Fei is scheduled to appear in court next month for sentencing.
