According to the court affidavit, on Dec. 15th, at about 8:24 a.m., a male individual (later identified as the victim) called the TPS to report that he and his sister’s ex-boyfriend Ualolo Fatulau (suspect) a.ka. “Paris”, got into a fight.

The victim stated that he told the suspect to leave his property numerous times but he refused to leave and stood outside their house demanding to speak to his sister.

There were no visible injuries on the victim and the suspect was still at large at the time of the incident and continued to harass the victim’s family.

The victim’s sister refused to be interviewed and does not want to be involved in the said matter.

At about 1:50 p.m., the officers interviewed the victim at the TPS. According to the victim, he verbally stated that he was sleeping when he heard his dog barking and it woke him up. When he got up to see who it was, he saw the suspect standing outside of their home. He then walked outside the house and confronted the suspect and told him he is not welcome on their property. He further stated that he told the suspect that his sister was not home but the suspect demanded to see his ex-girlfriend (victim’s sister).

The victim explained that he told the victim about nine times to leave but he refused. He then walked towards the suspect and continued to tell him to leave — this was for the 15th time — but he continued to refuse.

He explained that the suspect then got into a fighting stance and told him that he was not leaving until he saw his ex-girlfriend. The victim stated that the suspect attempted to punch him and they got into a fist fight.

The victim said that the suspect yelled profanities at him repeatedly and then picked up a rock and attempted to scare him by trying to throw the rock at him. He told the suspect to drop the rock and come fight him like a real man however the suspect continued to scare him with the rock.

The suspect then picked up a bigger rock and threw it at him where it missed his legs by inches.

The victim also gave the background story of what led to the incident.

He said that it all started on December 12th, when the suspect came to their house and demanded to see his sister. He informed the suspect that he was no longer welcome on their property since his sister had broken up with him. He stated he had to tell him twice to leave before he left.

Furthermore, the victim explained another incident occurred on Dec. 13th, whereby Fatulau came to the house about three times demanding to see his ex-girlfriend but again he told him to leave or he would beat him up so he left.

The suspect also showed up the following day, Dec. 14th, during the evening and midnight to try to talk to his sister. The victim stated he told him about 4 times to leave before he beat him up, instead of him calling the police.

On Dec. 14th, around midnight Fatulau called their house phone numerous times and again demanded to talk to his sister. He said that he swore at the suspect and told him to stop calling their house and he hung up the phone.

However, the suspect continued to call again 4 or 5 times and informed him that he was coming to their house to see his sister. The victim said he walked to the front road that leads to his house and waited for the suspect because he felt threatened and needed to protect his property and his father who was sleeping.

The victim also stated that the suspect does not live far from their residence and he indicated that he is concerned about his family’s safety.

On Dec. 15th, the suspect called the victim’s house again and demanded to talk to his sister. He told the suspect not to call again and he hung up the phone. Hethen went to the front entrance to see if the suspect would show up again and to his surprise he saw him walking towards their residence.

He then confronted the suspect and told him not to call or come to their property anymore. He then tried to apprehend the suspect but he avoided apprehension and escaped.

The defendant is identified as a 25-year-old U.S National.
