Neighbor fighting neighbor — man convicted of assault

Pago Pago, AMERICAN SAMOA — A 32-year-old who was convicted of assaulting his neighbor was ordered by District Court Judge, Fiti Sunia not to set foot on his neighbor’s land during the period of his probation — 12 months.

Alesana Valosaga was initially charged with 3rd degree assault, 3rd degree property damage, and public peace disturbance. However under a plea agreement with the government, Valoaga pled guilty to 3rd degree assault. The remaining charges were dismissed.

With his guilty plea, Valosaga admits that on May 10, 2018 he unlawfully entered inside his neighbor’s home by kicking the back door down and went inside with the purpose to commit a crime.

While he was inside his neighbor’s house, he punched his neighbor in his face multiple times, causing multiple face injuries. He further admits that he also threatened his neighbor by telling him that he would kill him if he ever touched his little brother again.

When given the chance to address the court, Valosaga apologized for his actions and immediately asked for a second chance to continue his care for his parent, and especially his young family. He told the court that everything back home has been settled. He also apologized to the victim for his actions.

After reviewing evidence of the case, Sunia then sentenced Valosaga to 12 months probation, subject to conditions.

“First condition, do not set foot on your neighbor’s land nor in his house. Stay away from that person and if you encounter him in public, walk away from him,” Sunia told Valosaga.

He was further ordered to remain law abiding, visit the Probation once a month, and to attend and complete anger management classes.
