Young man charged with statutory rape, and claims the unborn child is not his
Pago Pago, AMERICAN SAMOA — On February 26, 2025 parents of a 15-year-old female (a minor) walked into the Fagatogo Police Station (FPS) to report that their daughter was allegedly pregnant from a 22-year old man, who denies he is the baby’s father.
The suspect was later arrested and charged with:
Count 1, 3, 5, 7, & 9: Sodomy, a class B felony punishable by a term of imprisonment of up to fifteen years; and,
Count 2, 4, 6, 8, 10, & 11: Rape, a class B felony punishable by a term of imprisonment of up to fifteen years.
There was no bail set for the defendant.

According to the court affidavit, on Feb. 26, at about 2:30 p.m., police officers were assigned to investigate a walk-in at FPS.
Officers met with the parents of a 15-year-old girl, who reported that their daughter was allegedly raped and was pregnant from a 22-year-old suspect.
The parents explained that their daughter (victim) had been feeling sick lately, so they visited the LBJ Emergency Room with her. Upon examination, the attending physician informed them that the victim was about two weeks pregnant and they were advised to seek a social worker for further investigation.
Victim’s Statement:
The victim was interviewed with both parents present at the Criminal Investigation Division (CID) office in Fagatogo.
According to the victim, there were six incidents where she had sex with the suspect. She also revealed that a friend of hers introduced the suspect to her, and that the victim’s friend and the suspect are first cousins.
The victim stated that the first incident happened on January 1, 2025 at around 2:00 a.m. She stated that she snuck out of the house and went to her friend’s house which was nearby. There she waited for the suspect and a little past 2:00 a.m., the suspect showed up at her friend's house and told her to go with him to his house — it was across from her friend’s house.
She said they then went with the suspect but instead of his house, they went to an abandoned house next to her friend’s house. When they were inside the abandoned house it was dark and that’s when she had sex with the suspect.
The second and third incidents, occurring on Jan. 4th and Jan. 11th respectively, at the same time of night, but this time she snuck out to the suspect’s house and they both went into his room where they had sex.
The fourth incident occurred on Jan. 13th, but this time she skipped school during lunch at around 11:00 a.m. and went to the suspect’s house. At around noon time, they went into the suspect’s bedroom and had sex.
The victim claimed that the fifth incident occurred on Friday, January 17th, which mirrored the fourth incident — she skipped school and went to the suspect’s house.
The victim also stated that the last incident occurred on February 13th, at about 9:00 a.m. She claimed that she left her house at about 7:00 a.m. and went straight to the suspect’s house. She then took a nap with the suspect inside his bedroom and she woke up at around 9:00 a.m and they started having sex. At about 3:00 p.m, she noticed that the school day was over and that’s when she went home.
On Feb. 26th at about 6:41 p.m., following the victim’s interview with the CID, the victim was placed in a shelter under the care of Child Protective Services (CPS). The victim’s parents agreed to place her in the shelter awaiting their meeting with the CPS.
On Feb. 27th, at about 2:00 p.m., the suspect was interviewed by the authorities where he was Mirandized. The suspect waived his rights and agreed to make a statement and answer questions.
According to the suspect’s verbal and written statement, he admitted that he had multiple (6- 8) episodes of sex with the victim. The suspect also verbally stated that he did not know that the victim was a minor due to the build of her body. He also confessed to all the allegations of having sex with the victim.
The suspect was also aware of the victim’s situation of being pregnant but claimed that he is not the father. He alleged that he did not get the victim pregnant because he is not capable of getting any girl pregnant.
The defendant is identified as a 22-year-old U.S National.
