Gov makes recess appointment to hospital board

Pago Pago, AMERICAN SAMOA — In an Apr. 11 memorandum, Gov. Lemanu Peleti Mauga announced the recess appointment of Rep. Faimealelei A. Allen to the American Samoa Medical Authority Board of Directors.

According to the governor, this appointment is to fill the vacancy made by the resignation of Moefa’auo Bill Emmesley from the board of directors.

And this appointment “will be effective immediately and continue until the conclusion of the session of the Legislature unless he is confirmed by the Senate.” Additionally Rep. Allen’s appointment will be submitted to the Senate for confirmation.

No other information was available from the Governor’s Office on Moefa’auo’s resignation from the board — where he served as secretary — and had recently been appointed by the board as acting chief executive officer.

Faimealelelei served on the board during the previous administration.

A provision of local law allows a governor to make “recess appointments” — when the Fono is not in session — to fill vacancies caused by death, resignation, or removal of cause if the vacancy occurs while the Legislature is not in session. Recess appointments shall expire at the conclusion of the next following regular or special session of the Legislature.
