Man accused of sexually abusing his 16-year old biological daughter

A man who is accused of sexually abusing his biological daughter once a week throughout the month of August after he allegedly smoked ice was arrested over the weekend and made his initial appeared in District Court yesterday.

To protect the victim, Samoa News is not identifying the defendant by name. The defendant’s bail is set at $20,000 but it’s unclear at press time if he is yet able to post bail.

The defendant is charged with four counts of first degree sexual abuse, a felony each punishable by up to five years imprisonment, a $5,000 fine or both. The four counts represents one day week in August — Aug. 3, 11, 29, and 25th — in which the defendant is alleged to have committed the crime of sexual abuse, according to court documents.

The defendant is also charged with endangering the welfare of a child, a misdemeanor, punishable by up one year in jail, a fine of $1,000 or both.

According to court documents the 16-year old daughter reported to police that she was “sexually abused by her biological father,” the defendant. She told police it started on Aug. 3rd, after her mother was paid.

After that first night, and for the following weeks during the month of August on every Thursday, she would see the defendant lighting a pipe and smoking ice inside the bathroom. After smoking ice, the defendant would then walk to her bedroom, which has no door.

The government alleges in court document details of what the defendant did when he was inside the daughter’s bedroom, such as touching her legs, fondling her breast, but not her private parts. However, on the night of Aug. 18th the defendant tried to touch the victim’s private parts. She told police that she was “frightened” and said “no”, the government alleges.

She also told police that the incidents occurred during night time while her other siblings were at the grandparents’ house and her mother was sleeping with her youngest brother while her father “was inside her bedroom abusing her,” the government further alleges.

It’s also alleged the victim didn’t tell anyone because the defendant “threatened to kill her mother and siblings if she said anything to anyone,” according to court documents.

The defendant made his initial appearance in District Court yesterday where he was ordered that if the defendant is able to post bail, he is to find another place to stay, prohibited from making indirect or direct contact with his daughter, and banned from consuming drugs and alcohol. He is scheduled to appear again in court this morning for another hearing.
