UPDATE: Another random drug test, another arrest for Iosefo Sagote

Pago Pago, AMERICAN SAMOA — A man who is being accused of failure to comply with conditions of his release, where he was ordered to stay clean from illegal drugs and alcohol denied the allegation against him. The court has now set his case for a preliminary examination later on this month to determine if there is any probable cause to find him in violation of the court’s order.

The man, Iosefo N. Sagote was arrested again on Friday, June 29, after testing positive for marijuana. He appeared in High Court last Monday, July 2 for his initial appearance, where he denied the allegation against him. In an earlier story it was stated that he tested positive for meth after his attorney mistakenly provided that information to Samoa News.

Sagote is being charged with two counts; unlawful possession of a controlled substance (marijuana), a class D felony, and attempt to import a controlled substance (marijuana), a class A misdemeanor.

According to a report from the Probation Office, a probation officer administered a random urinalysis test on the defendant on June 29, 2018 around 10:35 a.m. at the District Court building. The urinalysis test result was positive for marijuana. Furthermore, the defendant also admitted to Probation that he allegedly smoked marijuana three weeks ago.

Sagote was later released from custody to await his next hearing, which is now scheduled later on this month, after he posted his bond which was established by the court. Furthermore, the court ordered the defendant to comply with exiting conditions of his release while his matter is pending in court.
